The petitioner claims to be a self-financed recognized teaching institute.

The grievance of the petitioner is that certain miscreants are causing disturbance and preventing the institution to function properly.

request has been made before the Superintendent of Police for posting police guard in the college premises at the cost of the college.

Learned advocate representing the State respondents is not ready with proper instruction. The persons against whom the complaint has been lodged before the police have not been impleaded as parties in the present writ petition. Without proper instruction from the police, the Court is not in a position to adjudicate as to whether the prayer of the petitioner seeking police protection is justified or not. Since it appears that the representation of the College seeking police protection is pending consideration at the end of the Superintendent of

Police, Cooch Behar, accordingly, the present writ petition is disposed of by directing the respondent no. 1, the Superintendent of Police, Cooch Behar to take a decision with regard to the prayer of the petitioner submitted before the said respondent on 27th February, 2023.

The aforesaid respondent shall give an opportunity of hearing to all the necessary parties and if it appears that posting of police guard will be required, then necessary consequential steps shall be taken. A decision shall be taken in the matter at the earliest, but positively by March 10, 2023.

It goes without saying that if the prayer of the petitioner for police posting is allowed, then the petitioner shall be obliged to pay the necessary charges for the same.

WPA No. 547 of 2023 is disposed of.
