The petitioner says that he was appointed as Assistant Teacher in Language Group on June 27, 2014 in Dr. Radhakrishnan High School situated at Rangit Mazuwa Busti, Darjeeling by the then authority of Darjeeling Gorkha Hill Council. He says that he was appointed by way of regular selection process. Since then, he has been working in the said post. However, till date, his appointment has not been approved by the Competent Authority.

He has made a representation addressed to, amongst others, the District Inspector of Schools (S.E.), Darjeeling. His only prayer is that such representation should be considered and decided at an early date.

Having heard learned Counsel for the parties, I direct the District Inspector of Schools (S.E.), Darjeeling, being the respondent no.4 herein, to consider the petitioner's representation dated March 11, 2020 (Annexure "P-9" to the writ petition) and take a reasoned decision thereon in accordance with the applicable Rules / Regulations, within a period of six weeks from the date of receipt of a copy of this order along with a copy of the representation, after giving an opportunity of hearing to the petitioner or his authorized representative. The decision so taken shall be communicated to the petitioner within a week from the date of the decision.

I have not gone into the merits of the petitioner's claim. The respondent no.4 shall take an informed decision in accordance with law.

Since I have not called for affidavits, the allegations in the writ petition are deemed not to be admitted by the respondents.

W.P.A. 679 of 2021 stands disposed of.
