1. The instant application for bail, filed at the behest of the WEDNESDAY COURT : 01 ITEM : 45 MATTER : 439 STATUS : ALLOWED BENCH ID : 1482 AR COURT : NANDY petitioner after being arrested in connection with NJP Case No. 784 of 2024 dated 11.08.2024 under Sections 137(2)/ 140(2)/3(5) of the Bharatiya Nyaya Sanhita.

2. Learned Counsel for the petitioner has submitted that the present petitioner is similarly circumstanced with another coaccused, namely Monoj Thakur who has been granted bail by order dated 14.02.2025. Other co-accused persons are also granted bail and as such the present petitioner being similarly circumstanced, may be enlarged on bail on any condition.

3. Learned Counsel for the State payer for bail but he has fairly submitted that the present petitioner is similarly circumstanced with the co-accused Monoj Thakur who has been granted bail on 14.02.2025.

4. We have perused the Case Diary along with the materials-onrecord. We find that the present petitioner is standing on the

P a g e | 2 same footing with the co-accused Monoj Thakur and as such we are inclined to allow the prayer for bail on the same condition.

5. Accordingly, The petitioner namely, CHRISTOPHER HEMBROM, shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the Learned Additional District & Sessions Judge, Third Court, Jalpaiguri, on condition that the petitioner shall attend the Trial Court on all the dates as fixed for hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever or commit similar offences in future. The petitioner shall not leave the territorial jurisdiction of the concerned Trial Court and furnish his address to the concerned Police Station where he will henceforth reside.

6. It is made clear that in the event, the petitioner fails to comply with any of the aforesaid directions, without justifiable cause, the further reference to this Court.

7. The application being CRM (DB) 140 of 2025 is accordingly disposed of.
