Banerjee) Mr. Subham Gupta ... for the petitioner Mr. Hirak Barman Ms. Bedashruti Bose ... for the State Ms. Supriya Singh ... for the NHAI The petitioners claim to be the owners of "RS plot nos. 43 and 45 situated in Mouza Binnaguri in the district of Jalpaiguri. The petitioners state that the aforesaid plots were acquired for the purpose of widening of the National Highways.

The grievance of the petitioners is that no compensation has been paid to the petitioners till date. The petitioners submitted a representation before the Special Land Acquisition Officer, Jalpaiguri and the competent authority by a letter dated February 18, 2025, but no decision on such representation has been communicated to the petitioner till date.

Heard the learned counsel for the State and the NHAI.

Since no decision on the representation has been communicated to the petitioners, this Court is of the considered view that interest of justice would be subserved if the concerned respondent authority is directed to take a decision on the representation of the petitioners and to communicate the decision to the petitioners within a specified time.

Without entering into the merits of the claim made in the representation as well as in the writ petition, WPA 591 of 2025 is disposed of by directing the Special Land Acquisition Officer, Jalpaiguri and the competent authority, being the 2nd respondent herein, to consider the representation of the petitioner dated February 18, 2025 and to dispose of the same in accordance with law by passing a reasoned order. The reasoned order shall be communicated to the petitioners immediately thereafter. The entire exercise shall be completed within a period of four weeks form the date of receipt of a server copy of this order along with the copy of the representation dated February 18, 2025.

In case the competent authority is of the view that any dispute as to the apportionment of compensation or as to the persons to whom the compensation is to be paid arises, steps in accordance with law shall be taken by the competent authority.
