As such, the petitioner would like to withdraw the application and file an appropriate application afresh on the self-same grounds.

On the prayer of the learned counsel appearing for the petitioner, the application is disposed of as withdrawn.

However, this shall not preclude the petitioner from filing an application afresh on the self-same grounds.

The question of maintainability of such application, however, is kept open.
