Mr. Sagnik Sankar Sikdar. ... For the State. Petitioner undertakes to affirm and stamp the petition/application as per Rules within a month of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through video conference. The petitioner submits that he is innocent and has been false implicated in this case and nothing has been found against him. We have heard the learned advocate for the State. We have perused the memo of evidence placed before us which includes the statements of the victim as also the person accompaning the victim on the date of incident and their statements

recorded under Section 164 of the Code of Criminal Procedure which reflect the name of the present petitioner in the conspiracy and in the commission of offence, particularly we have found the statement recorded under Section 164 of the Code of Criminal Procedure of Riya Das, a friend of victim Mousumi Sarkar, accompanied on the day of incident. Accordingly, we are not inclined to grant bail to the petitioner.

The application for bail is rejected.
