Mr. Kalipada Das ...for the Petitioner Mr. Hirak Barman Mr. Sourav Sarkar ...for the State Ms. Supriya Singh ...for the Respondent (NHAI) The petitioner alleges that the land of the petitioner measuring about 0.14 acres in LR Plot No 1281 within Mouza Purba Kathal Bari in the district of Alipurduar was acquired for the purpose of construction of the National Highway. The grievance of the petitioner is that neither any notice has been served upon the petitioner under Section 3G(4) of the National Highways Act, 1956 nor any compensation has been paid to the petitioner till date.

The petitioner claims to have submitted a representation dated 16th of December, 2024 before the Special Land Acquisition Officer, Land Acquisition Department, Jalpaiguri.

Without entering into the merits of the claim made in the representation dated 16th of December,

2024, WPA 603 of 2025 is disposed of by directing the Special Land Acquisition Officer being the competent authority under the National Highways Act, 1956 and the 2nd respondent herein to consider the representation dated 16th of December, 2024 and to dispose of the same by passing a reasoned order after giving an opportunity of hearing to the petitioner or his authorized representative.

It is needless to mention that the reasoned order shall be communicated to the petitioner immediately thereafter. The entire exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order along with a copy of the representation dated 16th of December, 2024.
