The parties to the instant appeal have settled the disputes inter se being the subject matter of the proceedings wherefrom the order under appeal emanates. The parties have filed a joint application being CAN 2 of 2025 setting out the terms of settlement as Schedule to the said application.

On a perusal of the terms of settlement, we find that the same to be apparently lawful. A query from this Court, it has clarified by the parties that no criminal case is pending in between the parties.

The appeal being FMAT 7 of 2025 as also the Title Suit No. 98 of 2024 (CIS No. 39 of 2024) stands disposed of in terms of the terms of settlement. A decree be drawn up by making the terms of settlement indicated in the Schedule to the application being CAN 2 of 2025 as part of the decree.

Let a copy of this order be sent to the Court of the learned Civil Judge (Senior Division) at Siliguri. All connected applications pending in this appeal stand disposed of without any further order.
