1. There are civil cases pending between the private parties.

2. Incident occurred when there were disputes with regard to cutting of crops. Issue as to whether or not, there was theft may be decided at the trial.

3. Considering the gravity of the offence and the involvement of the petitioners in the incident, it is appropriate to grant bail to the petitioner.

4. Accordingly, I direct that the petitioners shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, one of whom must be local, to the

satisfaction of the Learned Additional Chief Judicial Magistrate, Alipurduar, subject to condition that the petitioners shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

5. In the event petitioners fail to appear before the trial court without any justifiable cause, the trial court shall be at liberty to cancel their bail in accordance with law without further reference to this Court.

6. CRM(R) 11 of 2026 is disposed of.
