CALCUTTA HIGH COURT

IN THE CIRCUIT BENCH AT JALPAIGURI

27.08.2019 tkm/ct 1 C.R.M. 700 of 2019 sl no. 34 In Re : An application for anticipatory bail under section 438 of the Code of Criminal Procedure filed on 19.8.2019 in connection with Jalpaiguri Women P.S case no. 63 of 2019 dated 8.6.2019 under sections 498A/302/34 of the IPC and In Re : Purnima Roy & anr.

...... petitioners Mr. D. Kundu ...... for the petitioners Mr. A. S. Chakraborty Mr. Sourav Ganguly ...... for the State Heard the learned advocates appearing for the respective parties.

It is submitted that petitioner no. 1 has been arrested. Hence, her application for anticipatory bail is dismissed as infructuous.

Having considered the materials in the case diary disclosing prima facie involvement of the petitioner no. 2 in torturing the housewife who suffered unnatural death within six months of marriage, we are of the opinion that this is not a fit case to grant anticipatory bail to him.

Accordingly application for anticipatory bail is rejected. (Manojit Mandal, J.) (Joymalya Bagchi, J.)
