1. Learned counsel appearing for the petitioner submits as follows. The father of the de-facto complainant had taken a loan from one of the accused. There was a previous enmity. That is why the petitioner has been falsely implicated in this case. Charge sheet has been submitted. Three others co-accused were granted anticipatory bail by the Sessions Court.
2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He relies on the injury report and submits that the injury is grievous in nature. He also relies on the FIR and other statements of witnesses. Although the noting of the Investigating Officer mentions
that the injury was severe (grievous), the same is not clear from the injury report.
3. Considering the above, the other materials available in the case diary and the fact that charge sheet has been submitted, although I am inclined to grant anticipatory bail to the petitioner, his movement shall remain restricted for a limited period of time.
4. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall not threaten or intimidate witnesses. The petitioner shall surrender before the learned jurisdictional Court and pray for bail within four weeks from date. The petitioner shall regularly attend the jurisdictional Court. The petitioner shall also stay outside the jurisdiction of Dinhata Police Station for a period of six months except for meeting the I.O or attending the jurisdictional Court.
5. Accordingly, the application for anticipatory bail is allowed.
6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
