Having regard to the period of detention undergone by the petitioners and upon perusal of the FIR as well as the statement of the victim recorded under Section 164 of the Code of Criminal Procedure, we are of the view that there is no need to detain the petitioners any more in the custody and they should be granted bail.

Accordingly, CRM 359 of 2021 is allowed granting bail to the petitioners, namely, (i) Bikram @ Sagar Mondal and (ii) Guddu @ Gopal Karmakar, on furnishing bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Jalpaiguri.

The petitioners shall meet the Investigating Officer once in a week till the trial is concluded and shall not leave the jurisdiction of the trial court without leave of the Investigating Officer or the Presiding Officer, as the case may be.
