Chakraborty Mr. Aniruddha Biswas ...... for the State It is submitted on behalf of the petitioner that the dispute is civil in nature and the entire amount has been refunded to the de facto complainant and principal accused is on regular bail. Learned lawyer for the State submits that the petitioner in conspiracy with the principal accused cheated the de facto complainant of a large sum of money.
Having considered the materials in the case diary and bearing in mind the extent of complicity of the petitioner in the alleged crime and in the light of the submission that the principal accused is on regular bail and substantially monies have already been refunded to the de facto complainant, we are of the opinion though custodial interrogation of the petitioner is not necessary, petitioner requires to co-operate with investigation in accordance with law.
Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner shall meet the investigating officer once in a week while on bail until further orders and that the petitioner shall appear before the court below and pray for regular bail within four weeks from date.
