As prayed for by the learned Advocate for the petitioner, leave is granted to the learned Advocate on record of the petitioner to amend the cause title of the writ petition. Let such amendment be carried out, here and now.
The petitioner claims to be the owner of L.R. Dag no. 1677,1710 and 1724 within Mouza Uttar Madarihat under P.S.- Madarihat in the district of Alipurduar.
The petitioner alleges that the West Bengal State Electricity Transmission Company Limited have
erected poles and have drawn overhead transmission lines over the property of the petitioner.
The petitioner claims to have made representations before various authorities including the District Magistrate, Alipurduar by a letter dated January 21, 2025.
The learned Advocate for the petitioner submits that no decision has yet been communicated by the District Magistrate with regard to the prayer of the petitioner.
The learned Advocate appearing for the West Bengal State Electricity Transmission Company Limited submits that the licensee company has taken steps after obtaining requisite permission from the competent authority in this regard.
Without entering into the merits of the claim made in the representation dated January 21, 2025, WPA 610 of 2025 is disposed of by directing the District Magistrate, Alipurduar being the 4th respondent herein to consider the representation of the petitioner dated January 21, 2025 and to dispose of the same by passing a reasoned order after giving an opportunity of hearing to the petitioner, the transmission company and/or any other interested parties who may be affected by such decision. The reasoned order shall be communicated to the respective parties immediately thereafter.
The entire exercise shall be completed as expeditiously as possible but positively within a period of four weeks from the date of receipt of a server copy of this order along with a copy of the representation dated 21st of January, 2025.
