Subhash Barman @ Subash Barman v. State Of West Bengal
06.
07.04.2025 Court No.1 (Tanmoy) Rejected CALCUTTA HIGH COURT
IN THE CIRCUIT BENCH AT JALPAIGURI
APPELLATE SIDE CRM (A) 138 of 2025 In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 / Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023.
And In the matter of: - Sri Subhash Barman @ Sri Subash Barman ...petitioner.
Mr. Hillol Saha Podder ...for the petitioner.
Mr. Tapan Bhattacharjee Mr. Dhiman Sil ...for the State.
1. The petitioner says that he and the victim are neighbours. There was a dispute between them which resulted in a free fight between them. In the process, the victim may have been injured. He had no intention to hurt the victim. He prays for anticipatory bail.
2. Learned Advocate for the State opposes the prayer. He shows me the injury report. The victim suffered grievous head injury. Charge-sheet is pending. Investigation is not complete.
3. In view of the nature of the injury and prima facie complicity of the petitioner in the alleged crime, I am not inclined to entertain the petitioner's prayer for anticipatory bail. The prayer for anticipatory bail is thus rejected.
4. Accordingly, the application for bail being CRM (A) 138 of 2025 is dismissed.
