AGP Mr. Momenur Rahman ......for the State Mr. Bikramaditya Ghosh Mr. Soumyajyoti Dutta ...for the private respondent The petitioner is aggrieved with the selection of the private respondent as an ASHA Karmee in Haldibari Block under District Coochbehar. Alleging serious violation in respect of the selection process the petitioner submitted a representation before the concerned Block Development Officer. Since no steps were taken pursuant to such representation, petitioner approached this Court by filing a writ petition being WPA 1201 of 2023 which was disposed of by an order dated September 12, 2023 by directing the State respondents to consider the representation of the petitioner dated January 16, 2023 after hearing both the parties.

The learned Advocate appearing for the petitioner submits that pursuant to the said order the

petitioner was heard by the concerned Block Development Officer but no decision has yet been communicated to the petitioner.

Mr. Ghosh, learned Advocate appears for the private respondent and submits that the private respondent also appeared before the concerned Block Development Officer and produced materials in support of her case that she was rightly appointed as an ASHA Karmee. Mr. Ghosh also submits that no decision of such hearing has been communicated to the private respondent.

Mr.

Saha, learned Additional Government Pleader appears for the State and seeks an accommodation to take instructions from the concerned Block Development Officer.

Since it is not in dispute that the hearing had already taken place the authority has to communicate the decision of such hearing to the parties.

In view there of WPA 616 of 2025 is disposed of by directing the Block Development Officer, Haldibari Development Block being the 4th respondent to communicate the decision of such hearing to the parties.

If, however, no decision has been taken by the Block Development Officer the same shall be taken forthwith and communicated to the parties immediately thereafter.

The Block Development

Officer, Haldibari Development Block is directed to communicate the decision to the petitioner and the private respondents within a period of three weeks from the date of communication of a server copy of this order.
