Heard Mr. Sen, learned advocate appearing for the petitioner and Mr. Sarkar, learned advocate appearing for the State is presented along with case dairy.

By an order dated 08.04.2026, a Co-ordinate Bench directed the petitioner to surrender before the Court and apply for regular bail; however, it has been brought to my notice that the petitioner did not surrender before the learned Court below or apply for regular bail. Mr. Sarkar sought to persuade the Court that the prayer for anticipatory bail stood impliedly rejected by this Court vide its order dated 08.04.2026. However, such contention was opposed by Mr. Sen, who prayed for an extension of time to enable the petitioner to surrender before the learned Court below and apply for regular bail. The said prayer was vehemently opposed by Mr. Sarkar.

Having noted the rival contentions of the parties, I am of the view that the issue requires further consideration. However, Mr. Sen is only interested in seeking an extension of the period granted to him to surrender and to apply for regular bail.

In view thereof, list this matter be placed before the next available Circuit Bench.
