This is an application for transfer filed by the wife of the complainant of the Complaint Case being CR Case No.542 of 2021 from the court of the learned 2nd Judicial Magistrate at Siliguri to learned Judicial Magistrate at Cooch Behar. Considering the inconvenience faced by the wife i.e. the applicant herein and considering the uncontroverted pleading despite notice that the petitioner/wife filed one case being Women Police Station, Cooch Behar Case No. 77 of 2021 under Section 498A where the opposite party is appearing, I

direct transfer of all records of CR Case No.542 of 2021 from the court of learned 2nd Judicial Magistrate at Siliguri, Darjeeling to the court of the learned Judicial Magistrate at Cooch Behar.

The department is directed to take all appropriate steps for sending the case record of CR Case No.542 of 2021 pending before the 2nd Judicial Magistrate at Siliguri, Darjeeling immediately so that the trial can start before the learned Judicial Magistrate at Cooch Behar.

The Criminal Revisional Application is disposed of as allowed.
