The petitioner claims to be the owner of several plots of land including L.R. plot no. 6949 under Khatian No. 1490/1 within Mouza Marichbari under the Police Station Pundibari in the District of Coochbehar. The petitioner states that the aforesaid plot of land of the petitioner was utilized for the purpose of construction of four lane national highway but till date no compensation has been paid to the petitioner in respect of the aforesaid plot. The petitioner claims to have submitted a representation before the Special Land Acquisition Officer which was received by the office of the Special Land Acquisition Officer on 6th January, 2021.
Learned advocate for the State submits that different plot numbers have been mentioned in different places in the said representation and in view thereof
the Special Land Acquisition Officer could not consider the claim of the petitioner.
At this stage Mr. Dey, learned advocate appearing for the petitioner prays for liberty to file a further representation before the Special Land Acquisition Officer.
In the light of the submission made by the learned advocate for the petitioner, the petitioner will be at liberty to make a comprehensive representation before the Special Land Acquisition Officer, Coochbehar with regard to his claim for compensation. If such representation is submitted the Special Land Acquisition Officer shall consider and dispose of the same in accordance with law by passing a reasoned order.
With the above observations and directions, WPA 620 of 2025 stands disposed of.
No order as to costs.
