In Re: An Application under Section 482 of the Code of Criminal Procedure, 1973.

The present revisional application was preferred challenging the proceedings arising out of New Jalpaiguri Police Station Case No. 969 of 2020 dated 09.08.2020 (G.R. No. 3418 of 2020) under Sections 406/420 of the Indian Penal Code.

The contention advanced in this revisional application relates to question of facts. The stage at which the petitioners approached this Court reflects that the investigation of the case was in progress. Having regard to the contentions advanced in this revisional application, I grant liberty to the petitioners to approach this Court after the report under Section 173 of the Code of Criminal Procedure is submitted before the jurisdictional court and the copies under Section 207 of the Code of Criminal Procedure are served to the petitioners.

Accordingly, the revisional application being CRR 70 of 2021 is disposed of.

Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
