Mr. Ghosh, learned advocate, who usually represents the District Primary School Council, Alipurduar, is requested to appear in this matter. Let a copy of the writ petition be served upon Mr. Ghosh in course of this day.
The petitioner is an Assistant Teacher at Garanda East Line Primary School under Madarihat Circle in the District of Alipurduar. The petitioner states that it is difficult for the petitioner to attend the school from his
residence and for such reason he applied for transfer to a nearby school.
When this matter is taken up for hearing the learned advocate appearing for the petitioner submits that pursuant to the prayer for transfer made by the petitioner she was called for hearing by the authorities of the District Primary School Council, Alipurduar. He further submits that the petitioner duly attended the said hearing and before such authority he has stated that Saraswati Hindi Primary School within Kalchini Circle is a teacher deficit school which is near to the residence of the petitioner. The petitioner requested the said authority by a letter dated March 20, 2025 to transfer the petitioner to Saraswati Hindi Primary School under Kalchini Circle.
Learned advocate appearing for the petitioner submits that no decision on such prayer of the petitioner has yet been communicated to the petitioner. Since the petitioner attended the hearing conducted by the Chairman cum Secretary, District Primary School Council, Alipurduar being the 5th respondent herein, such authority is directed to take a decision on the issue for which hearing was conducted and to communicate such decision to the petitioner as expeditiously as possible but positively within a period of four weeks from the date of receipt of a server copy of this order along with the copy of the representation
praying for transfer as well as the letter dated March 20, 2025 which has been produced in course of hearing of this writ petition.
With the above observations and directions, WPA 623 of 2025 stands disposed of.
A copy of the letter dated March 20, 2025 which has been produced in Court today by the learned advocate for the petitioner is taken on record. No order as to costs.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
