Learned advocate appearing for the petitioners submit that from the possession of three accused persons 26.5 kgs of contraband/ganja were seized and accordingly the case was registered for investigation on 29.10.2024, when all the three persons were arrested and taken into custody. It has further been submitted that since 29.10.2024 the petitioners are in custody and the investigation of the case has already been concluded and charge-sheet submitted before the Jurisdictional Court.
Learned advocate appearing for the State raises objection and submits that since charge-sheet has been submitted and the contraband has been confirmed by the FSL, the release of the petitioners may jeopardize the further progress of the case.
Be that as it may, since the petitioners are in custody for more than seven months, I am of the view that the trial will consume substantial time.
Accordingly, further detention may not be warranted so far as the petitioners are concerned.
As such the petitioners are directed to furnish bond to the satisfaction of the learned Special Court. It is directed that two sureties may be directed to furnish the bond on behalf of each of the petitioners, one of whom must be local and it is further clarified that the local sureties for the purposes of the case would be of a person who would deposit the title deed of his property. Petitioners would make themselves available on each and every date of trial and would cooperate with the learned trial Court for progress of the case. In case any violation of the aforesaid conditions, the learned Special Court would be at liberty to cancel the bail without further reference to this Court. Accordingly, CRM (NDPS) 90 of 2025 is allowed.
