Calcutta High Court In the Circuit Bench at Jalpaiguri 28.08.2019.

as (Rejected) C.R.M. 728 of 2019 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 24.06.2019 in connection with Dinhata Women P. S. Case No.25 of 2019 dated 10.06.2019 under Sections 493/376/417/109 of the Indian Penal Code.

In the matter of : Anup Kumar Barman.

... Petitioner.

Ms. Suman Sehanabis (Mandal).

...for the Petitioner.

Mr. Arun Kr. Sarkar, Mr. Arijit Sarkar.

.....for the State.

Heard the learned Advocates appearing for the parties. Report is placed on record.

Having considered the materials on record prima facie disclosing involvement of the petitioner in cheating the defacto complainant and her family members and misappropriating monies paid to him in consideration of a proposed marriage which subsequently was broken by him, we are of the opinion that this is not a fit case to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
