The grievance of the writ petitioner, who is the estranged wife of the respondent no.6, is the inaction of the police authorities in respect of a complaint made by the petitioner on 9th March, 2021.

Learned counsel appearing for the petitioner submits that the complaint made to the police relates to the unauthorized operation of a bank account by the respondent no.6 and that the police did not take any steps after registration of the complaint on 16th March, 2021.

Learned counsel appearing for the State hands up a report dated 16th April, 2022 but submits that there has been a delay in the investigation due to

transfer of the concerned officer from Siliguri to another place.

Learned counsel appearing for the respondent no.6 disputes the allegations made in the writ petition and submits that the petitioner and the respondent no.6 are partners in a firm which has operated the bank account forming the subject matter of the complaint made by the petitioner to the police. After hearing learned counsel and as suggested on behalf of the petitioner, WPA 790 of 2022 can be disposed of with the direction on the respondent no.3 being the Inspector-in-Charge, Siliguri Police Station, to conclude the investigation within a period of eight weeks from today.

The result of the investigation shall be made available to the petitioner so that the petitioner has the liberty for taking appropriate steps pursuant to the investigation.

The respondent no.3 shall also look at any subsequent facts which may have been urged by the petitioner before the police authorities.

WPA 790 of 2022 is disposed of in terms of the above.
