The order impugned passed by the District Magistrate, Cooch Behar on 17th February, 2023 is assailed in the writ petition.

The order is appellable under Rule 51 of the West Bengal Minor Minerals Concession Rules, 2016. Learned counsel for the petitioner seeks to withdraw the writ petition with liberty to approach the appropriate forum for redressal of the grievance of the petitioner. In view of the above, the writ petition being WPA 584 of 2023 is dismissed for non-prosecution. Liberty is granted to the petitioner to approach the appropriate forum for redressal of his grievance.

However, there shall be no order as to costs.
