The petitioner is aggrieved by the inaction of the police authorities in respect of a complaint filed by the petitioner on 23rd March, 2022. According to learned counsel appearing for the petitioner, the petitioner was heckled by some henchmen on 22nd March, 2022 and the men forcibly entered into the petitioner's land. These persons have been named in the complaint. The private respondents have also been named in the said complaint.
Learned counsel appearing for the State submits that the petitioner has only written to the Commissioner of Police but has not filed an FIR before the concerned Police Station till date.
Upon hearing learned counsel, this court is of the view that the writ petition may be disposed of with liberty given to the petitioner to approach the Ambari Out Post under New Jalpaiguri Police Station, which is the jurisdictional Police Station in the present case by filing a complaint.
If and when such FIR is lodged, the respondent nos.3 and being the Officers-in-Charge, New Jalpaiguri Police Station and Ambari Out Post under New Jalpaiguri Police Station shall take steps to initiate investigation on the satisfaction of the existence of facts as stated in the letters written by the writ petitioner. WPA 791 of 2022 is disposed of in accordance with law.
