IN THE CIRCUIT BENCH AT JALPAIGURI
27.08.2019 tkm/ct 1 C.R.M. 740 of 2019 sl no. 39 In Re : An application for anticipatory bail under section 438 of the Code of Criminal Procedure in connection with Samuktala P.S case no. 172 of 2018 dated 29.7.2018 under sections 147/148/149/431/448/326/307 of the IPC adding section 302 of the IPC and In Re : Bablu Mahato & Anr.
...... petitioners Mr. S. Ganguly ...... for the petitioners Mr. U. Luksom Mr. A. Biswas ...... for the State Heard the learned advocates appearing for the respective parties.
Having considered the materials in the case diary disclosing prima facie involvement of the petitioners as members of unlawful assembly which assaulted the victim after branding her as a witch resulting in her death, we are of the opinion that in view of the gravity of the offence this is not a fit case to grant anticipatory bail to them.
Accordingly application for anticipatory bail is rejected. (Manojit Mandal, J.) (Joymalya Bagchi, J.)
