CIRCUIT BENCH OF CALCUTTA HIGH COURT AT JALPAIGURI June 06, 2022 ARDR (5) WPA 744 of 2021 Kusumbala Mandal & Ors.

Vs.

The State of West Bengal & Ors.

Mr. Debajit Kundu, ...for the petitioner.

Mr. Hirak Barman, Mr. Pretom Das, ...for the State.

Affidavit of service filed by the petitioners is taken on record.

The grievance of the petitioners is that they are recorded owners of the plots in question which were acquired by the State respondents. No compensation has been paid to the petitioners for the same. The petitioners submitted a representation (Annexure P/2 to the writ petition) through their learned advocate before the concerned authority which is yet to be disposed of. The petitioners pray for a direction upon the authority to consider the representation at the earliest.

Having considered the submissions made on behalf of the parties and material on record, the writ petition is disposed of directing the 2nd respondent to consider and dispose of the representation submitted by the petitioners (Annexure P/2 to the writ petition) within a period of two months from the date of

communication of this order after giving reasonable opportunity of hearing to all the interested parties including the petitioners, in accordance with law. The decision taken by the authority shall be communicated to the petitioners within a week thereof. With the above directions, WPA 744 of 2021 is disposed of. However, there shall be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
