Calcutta High Court In the Circuit Bench at Jalpaiguri 30.08.2019.
as (Rejected) C.R.M. 765 of 2019 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 26.08.2019 in connection with Bhaktinagar P. S. Case No.1281 of 2014 dated 08.09.2014 under Sections 448/376(1)/306 of the Indian Penal Code.
In the matter of : Bablu Karigar @ Haque.
... Petitioner.
Mr. Debajit Kundu.
...for the Petitioner.
Mr. Arun Kr. Sarkar, Mr. Tapan Bhattacharjee.
.....for the State.
Heard the learned Advocates appearing for the parties. Having considered the materials on record prima facie disclosing involvement of the petitioner in trespassing into the residence of the victim and forcibly ravishing her and as he had absconded for a protracted period of time, we are of the opinion that this is not a fit case to grant anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
