For the petitioner/plaintiff The fundamental issue in this application is relating to a prayer for early disposal of Title Suit No.35 of 2016 pending before the learned Civil Judge (Junior Division), Additional Court, Sadar Cooch Behar.

Considering the nature of prayer, i.e., expeditious disposal, I find hardly any necessity to ask for service of notice upon the opposite parties. Thus, service of notice upon the opposite parties stands dispensed with.

The learned Civil Judge (Junior Division), Additional Court, Sadar Cooch Behar, is requested to dispose of the Title Suit No.35 of 2016, as expeditiously as possible, without granting any unnecessary adjournment to either of the parties in any case save and except extreme urgency.

With the above observation, the revisional application, being CO 26 of 2023, stands disposed of.

Learned advocate appearing on behalf of the petitioner is at liberty to bring this order to the notice of the learned Civil Judge (Junior Division), Additional Court, Sadar Cooch Behar, forthwith.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
