Karima Khatun v. The State Of West Bengal
04.04.2025 Item no. 15.
Court No.1.
S.De Calcutta High Court In the Circuit Bench at Jalpaiguri CRM (A) 196 of 2025 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
And In the matter of : Karima Khatun.
......Petitioner.
Mr. Sudip Guha, ......for the Petitioner.
Mr. Tapan Bhattacharjee, Mr. Dhiman Sil, ......for the State.
1.
The petitioner says that he has no significant role to play in the alleged offence of kidnapping. Her husband, who is a co-accused and was arrested, has been enlarged on bail by this Court. She is prepared to cooperate with the police authorities. 2.
Learned State counsel shows me the material in the case diary including the statement of the victim girl recorded under Section 164 Cr.P.C.
3.
I find that this case is of 2014. The victim girl was 12 years of age at that time. She clearly says that this petitioner and her husband kidnapped her and took her to Delhi. There she was sole to a third party. Wrong things were done to her.
4.
I, therefore, see that this petitioner evaded the police successfully for a long time. Given the nature and
gravity of the alleged offence and the petitioner's prima facie involvement therein, even though the petitioner is a lady, I am not inclined to entertain her prayer for anticipatory bail.
5.
CRM (A) 196 of 2025 is dismissed.
