The petitioners are aggrieved by the order dated 27th February, 2023 passed by Commissioner, Siliguri Municipal Corporation.

It appears that the said impugned order has already been set aside by this Court vide judgment dated 30.03.2023 passed in WPA 617 of 2023 with WPA 642 of 2023.

Learned advocate representing the Siliguri Municipal Corporation submits that the direction passed in the judgment dated 30.03.2023 shall be complied with. Learned advocate representing the respondent no. 7 opposes the prayer of the petitioners.

It has been submitted that the Siliguri Municipal Corporation has not yet taken steps to conduct the inspection and in the meantime unauthorised construction and demolition are going on.

As it appears that the order impugned in the present writ petition has already been set aside, accordingly, no further order is required to be taken in the instant writ petition. The direction passed in WPA 617 of 2023 will apply in the present case.

All the parties are directed to act in accordance with the direction passed in the judgment dated 30.03.2023. Affidavit-of-service filed today in Court be kept with the records.

The writ petition stands disposed of.
