This is an application of post arrest bail under Section 483 of the Nagarik Suraksha Sanhita, 2023.

Learned Counsel for the petitioner submitted that the petitioner is in custody for more than one year. It was further submitted that the co-accused was granted bail earlier by a Co-ordinate Bench of this Court. The Learned Counsel also invited attention to the fact that in the arrest memo there was no independent witness but name of a Civic Volunteer is there.

I have perused the C.D. and heard the Learned Counsel for the State.

The co-accused was granted bail by the Coordinate Bench on the ground that the fact that the co-accused possessed valid licence under Drugs and Cosmetics Act, 1940. That circumstance is not applicable here. No drug licence has been produced by the present. This apart, considerable about of contraband article was recovered from the present accused.

On perusal of C.D. and other materials and also considering the nature of offence, I am not inclined to allow bail.

Accordingly, the instant application stands rejected.
