None appears for the 6th respondent despite service.
The petitioner claims to be the recorded owner of the plot in question and complains that the respondent Authorities, more particularly, the 2nd respondent is trying to dispossess the petitioner from the said plot for the purpose of reconstruction of barbed wire fencing adjoining the said plot.
It is submitted on behalf of the State respondents that the petitioner only apprehends acquisition of the plot in question. It is submitted by the learned counsel,
on instructions, that in the event the plot owned and occupied by the petitioner is required for the purpose of such construction, the same shall be acquired in due process of law. At present no such proposal has been initiated by the State Authorities.
In view of the submissions made on behalf of the State Authorities, nothing further remains to be adjudicated in the writ petition.
Accordingly, W.P.A. 809 of 2022 is disposed of. There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
