1. The grievance of the petitioner is directed against non-release of his pensionary benefits. It is submitted on behalf of the petitioner that despite having long retired they are yet to receive their pensionary and other gratuity benefits.

2. On behalf of the Kurseong Municipality being the respondent no. 5 & 6 despite repeated adjournments they have been unable to give any response to the prayer of the petitioners.

3. The State is represented and submits that they have made necessary payments to the Kurseong Municipality and it is Kurseong Municipality which is delaying payment.

4. In view of the submissions made on behalf of the parties, WPA/560/2026 stands disposed of by directing the concerned Municipality being the respondents no. 5 and 6 to ensure payment of the petitioners gratuity dues, arrear pension and monthly current pension within a period of eight weeks from the date of communication of this order only after proper and necessary verification of their claims.

5. It is a troublesome state of affairs that the respondent Municipality which is suppose to be a role model employer is unnecessarily procrastinating payment of the dues payable to the petitioner.
