Ganguly Mr. Sayantan Bhowmik ..for the petitioner Mr. Subir Kumar Saha Mr. Pradip Sarkar ..for the State The petitioner alleges that the Commissioner of School Education, West Bengal being the 4th respondent has not complied with the directions contained in the order dated 7th March, 2022 passed by a Co-ordinate Bench in WPA 688 of 2021. The petitioner submitted a representation dated January 20, 2025 requesting the said authority to take steps in terms of the aforesaid order.
Mr. Chakraborty, learned advocate appearing for the petitioner, in his usual fairness, submits that after filing of the writ petition the petitioner was served with a hearing notice dated March 18, 2025 requesting him to appear before the Commissioner of School Education, West Bengal at Salt Lake on March 28, 2025.
Mr. Chakraborty submits that the petitioner received the said letter only on March 25, 2025 and requested the said authority to fix a further date of hearing to enable the petitioner to attend the hearing. He further submits that no communication has been received from the end of the 4th respondent till date. Mr. Saha, learned Additional Government Pleader appears for the State and submits that a further date will be fixed for hearing by the Commissioner of School Education, West Bengal if this Court permits the said respondent to do so.
After hearing the learned advocates for the respective parties, this Court is of the considered view that the ends of justice would be sub-served if the 4th respondent is directed to fix another date of hearing. At this stage, Mr. Saha, learned Additional Government Pleader submits that the hearing will be conducted on 25th April, 2025 at 1 p.m. in the office chamber of the Commissioner of School Education at Bikash Bhawan, 7th Floor, Salt Lake City, Kolkata-700 091.
Mr. Chakraborty, learned advocate appearing for the petitioner submits that since the date and time has been fixed by the Court the petitioner will attend the said hearing and shall not insist upon any further notice to be served by the respondent to the petitioner.
It is, however, made clear that this Court has not entered into the merits of the claim raised by the petitioner in this writ petition and the said respondent shall be free to decide the same in accordance with law. With the above observations and directions, WPA 643 of 2025 is disposed of.
No order as to costs.
