The petitioner alleges that the lands of the petitioner was acquired for the purpose of construction of railway line but no compensation has yet been released in favour of the petitioner. The learned Advocate appearing for the State submits that the petitioner purchased the land long after the initiation of the acquisition proceedings. He further submits that payment of compensation has already been made to the land owners.
However, the person to whom the compensation has been paid and when such amount was paid has not been disclosed.
It appears that the petitioner has submitted a representation dated 4th of October, 2024 before the
Special Land Acquisition Officer, Coochbehar. The grievance of the petitioner is that no decision on such representation has been communicated to the petitioner till date.
Without entering into the merits of the claim made by the petitioner in the representation, WPA 646 of 2025 is disposed of by directing the Special Land Acquisition Officer, Coochbehar being the 6th respondent to consider the representation of the petitioner dated 4th of October, 2024 and to dispose of the same by passing a reasoned order after giving an opportunity of hearing to the petitioner or his authorized representative.
It is needless to mention that such reasoned order shall be communicated to the petitioner immediately thereafter. The entire exercise shall be completed within a period of six weeks from the date of receipt of a server copy of this order along with a copy of the representation dated 4th of October, 2024.
