Ct. 3 RS In the High Court at Calcutta Circuit Bench at Jalpaiguri Constitutional Writ Jurisdiction Appellate Side WPA 643 of 2023 Baby Begum -versusState of West Bengal and Ors.

Ms. Matan Chakraborty Mr. Sasthi Charan Dhara ... for the petitioner.

Mr. Subir Kumar Saha Mr. Momenur Rahaman ... for the State.

Counsel for the respective parties are present.

The petitioner has filed the present writ application praying for a direction upon the respondent authorities for consideration of her representation for appointment of Panchayat Karmi as the name of the petitioner is appearing at serial no.4 in the reserved list of the exempted category out of which two posts are still vacant and as such the petitioner can be accommodated in the said two vacant posts.

On the other hand, learned counsel for the respondents submits that the name of the petitioner

is appearing at serial no.4 in the reserved list for the posts of reserved candidate for exempted category and the other three candidates whose names are above the petitioner are entitled to be appointed if there is any vacancy and as such the petitioner cannot claim appointment leaving the candidates who are meritorious than the petitioner.

In view of the submission made by the counsel for the respective parties, this Court finds that no purpose would be served by keeping this writ application pending.

Accordingly, the respondent no.2 is directed to consider the representation of the petitioner by giving an opportunity of hearing to the petitioner and to pass a reasoned and speaking order within six weeks from the date of communication of this order. WPA 643 of 2023 is thus disposed of.
