The petitioner has filed the present writ application praying for disbursement of retirement benefit and pension benefit to the petitioner in terms of the order passed by the District Panchayat and Rural Development Officer dated 6th June, 2022.

Counsel for the respondents submits that as per the order passed by the District Panchayat and Rural Development Officer, the provident fund and leave salary have been released which has been duly confirmed by the Counsel for the petitioner but the pensionary benefits and the other benefits have not yet been released.

Counsel for the respondents submits that the release the pensionary benefits and other

benefits including the gratuity is pending before the competent authority for approval.

In view of the submission made by the Counsel for the respondents, this Court directs the respondent nos. 3 and 4 to release the pension, gratuity and other benefits in terms of the order passed by the District Panchayat and Rural Development Officer, Dakshin Dinajpur within a period of four weeks from the date of receipt of the copy of the order.

It is made clear that if the authorities fail to release the said amount within four weeks, the amount will carry interest at the rate of 10 per cent per annum till realization of the said amount. WPA No. 644 of 2023 is thus disposed of.
