Mr. Kamalesh Bhattacharyya Mr. Aninda Bhattacharyya Mr. Debajit Kundu ...for the Petitioner Mr. Subir Kumar Saha(AGP) Mr. Pretom Das ... for the State Mr. Bikramaditya Ghosh ... for the SSC Pursuant to an order passed by a co-ordinate Bench of this Court on 14th July, 2022 in W.P.A. 1843 of 2021 directing the District Inspector of Schools (S.E.), Cooch Behar to take a decision on the representation submitted by the petitioner on September 24, 2021 seeking transfer, the District Inspector of Schools considered the representation and by an order passed on 30th August, 2022, recommended the petitioner's prayer for transfer and sent the matter to the West Bengal Central School Service Commission, being the 2nd respondent herein,

on 7th November, 2022 for taking necessary decision thereon.

Learned counsel for the petitioner submits that no decision has been taken by the 2nd respondent till date. The petitioner seeks a direction upon the 2nd respondent to issue transfer order in favour of the petitioner in terms of the recommendation made by the District Inspector of Schools (S.E.) being the 5th respondent therein.

Upon consideration of the submission made on behalf of the parties and material on record, the writ petition is disposed of directing the 2nd respondent to issue necessary transfer order in favour of the petitioner in terms of the recommendation made by the 5th respondent in his order dated 30th August, within two weeks from the date of communication of this order.

All consequential steps be taken by the authority following the order within one week thereafter.

The said order be communicated to the petitioner within a week thereof.

There shall however be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.

Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
