Noor Nabi Ali v. State Of West Bengal
29.08.19 Sl. No.12 akd Ct. No.1 [Rejected] CALCUTTA HIGH COURT In the Circuit Bench at Jalpaiguri C. R. M. 812 of 2019 In Re: An application for bail under Section 439 of the Code of Criminal Procedure filed on 27.08.2019 in connection with Sahebganj Police Station Case No. 333 of 2018 dated 22.07.2018 under Sections 14A/14C of the Foreigners Act.
And In Re: Noor Nabi Ali ... ... Petitioner Mr. Sudip Guha .. Advocate ... ... for the petitioners Mr. Aditi Shankar Chakraborty .. Ld. Addl. Public Prosecutor Mr. Sourav Ganguly .. Advocate ... ... for the State The petitioner is seeking bail in connection with a case relating to offences punishable under Sections 14A/14C of the Foreigners Act. It is submitted on behalf of the petitioner that he is in custody for about 402 days and that he is an Indian citizen. Learned Additional Public Prosecutor opposes the prayer for bail and submits that trial is in progress.
Having considered the materials on record disclosing prima facie involvement of the petitioner in the alleged crime and as trial is in progress, we are of the opinion that this is not a fit case to grant bail to the petitioner at this stage.
The application for bail is thus rejected.
Trial court is directed to expedite the trial and conclude the same at an early date preferably within six months from the next date
fixed before the said court for recording evidence without granting unnecessary adjournment to either of the parties. (Manojit Mandal, J.) (Joymalya Bagchi, J.)
