Learned Counsel appearing for the petitioner submits that the whole amount of Rs.1,67,26,050/- has been deposited with the Bank and the petitioner promises to pay Rs.1,68,950/- by way of TDS and to submit e-challan to the Bank at an earliest.
Learned Counsel appearing for the Bank accepts that the whole amount of Rs.1,67,26,050/- has been paid by the petitioner, and , if the TDS e.challan is submitted before the Bank, the Bank has no objection to execute the sale deed within three months.
Heard both the parties.
As the whole amount except TDS has already been paid and the petitioner promises to pay the TDS as early as possible, the Bank is
requested to execute the sale deed within two months from today, if the petitioner submits the echallan showing payment of TDS within seven days from today. The Bank is requested to handover the said property to the petitioner before the execution of Sale deed.
With the above direction WPA 764 of 2021 with CAN 1 of 2021, CAN 2 of 2021 and CAN 3 of 2021 are disposed of.
Since no affidavits have been invited, the allegations contained in the writ petition are deemed not to have been admitted by the respondents.
There will be no order as to costs.
The parties shall act in terms of the copy of the order downloaded from the official website of this Court.
