This is a contempt proceeding arising from an order dated January 30, 2025, annexure-C at page125 to the contempt application.
Referring to the order dated January 30, 2025, both the learned counsel submit that instead of respondent no.2, respondent no.3 in the writ petition is the appropriate authority for carrying out the direction of this Court dated January 30, 2025.
Learned counsel for the petitioner submits that the solitary charge of contempt is that the issue has not been considered as per the direction of this Court dated January 30, 2025.
Since the appropriate and jurisdictional authority is the respondent no.3 in the writ petition so the question of carrying out the direction by the respondent no.2 did not arise at the relevant point of time. However, the same has been pointed out before this Court today in this contempt proceeding.
In view of the above, it is clarified that the respondent no.3 shall carry out the direction of this Court dated January 30, 2025 in true spirit and terms of the order but the time frame shall recon from today. The rest of the directions remain unaltered and without any modification in the order dated January 30, 2025.
With the above observations, this contempt proceeding being CPAN 14 of 2025 stands dropped and closed.
Accordingly, the application CPAN 14 of 2025 stands disposed of.
