Learned advocate appearing for the petitioner submits that the petitioner was arrested on 02.11.2023 and similarly placed accused person has already been granted bail by a coordinate Bench of this Court on 28.04.2025 in CRM (NDPS) 95 of 2025.

Mr. Biswas, learned advocate appearing for the State opposes the prayer for bail and submits that huge quantity of contraband was recovered from the joint possession of the petitioner and another.

Having regard to the fact that the petitioner is similarly placed as the other accused person who had been granted bail, I am of the opinion that the petitioner would be entitled to the same benefit. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner is released on bail on same terms and conditions as the other accused. Consequently the following conditions are imposed :

The petitioner namely, Sudip Das be released on bail upon furnishing bond of Rs.20,000/- with two registered sureties of Rs.10,000/- one of which must be local to the satisfaction of the learned Judge, Special Court (NDPS), Siliguri, on further condition that he shall attend court on each and every date fixed during trial unless exempted and shall not tamper with any evidence and threaten any witness during pendency of the trial.

The petitioner shall not leave the jurisdiction of District Darjeeling and Coochbehar (being resident of Coochbehar and case pending at Siliguri, District Darjeeling) without prior permission of the learned Additional Sessions Judge, 1st Court (NDPS), Coochbehar, until further orders. The application for bail, being CRM (NDPS) 118 of 2025, is, thus, disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
