The petitioner says that all other accused persons have been granted anticipatory bail. There was a usual marital fight between him and his wife being the victim in this case. The incident has been blown out of proportion. He is willing to cooperate with the Investigating Officer. He prays for anticipatory bail.

Learned State Advocate while opposing the prayer, shows me the medical report. The injury suffered by the victim is simple in nature.

On an overall assessment of the material on record and the nature and gravity of the alleged offence, I am of the view that immediate custodial detention of the petitioner may not be necessary so long as he cooperates with the Investigating Officer.

Accordingly, in the event of arrest, the petitioner, namely Pritam Sarkar shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that the petitioner shall report to the Investigating Officer of the concerned Police Station once in a fortnight until further orders.

In case the petitioner fails to adhere to any of the conditions mentioned hereinabove or in Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 6.

The application for anticipatory bail being CRM (A) 205 of 2025 is disposed of.
