Heard the learned counsel appearing on behalf of the parties. Perused the case diary.

This application for bail is canvassed on the ground that the petitioner is in custody for more than three months. 3.

Charge-sheet has been filed and case is fixed for trial on 2nd May, 2026 to 5th May, 2026.

This Court has considered the statement of the victim under Section 164 of the Code of Criminal Procedure and the medical report. The medical report indicates that the petitioner used his middle finger in the private parts of the victim and also molested her.

It is submitted by the Counsel for the petitioner that the petitioner is serving as army personnel and must be treated with leniency.

Having regard to the medical evidence and the statement recorded under Section 164 of the Code of Criminal Procedure, this Court is of the view that an army personnel is expected to conduct himself with more discipline and respect towards women.

Considering the above, this Court is not inclined to enlarge the petitioner on bail.

Case Diary be returned.

C.R.M. (M) No. 98 of 2026 is, thus, dismissed. 10.
