The grievance of the petitioner is that the petitioner has participated in the seventh Regional Level Selection Test 2006 for the post of Assistant Teacher in Bengali and thereafter the name of the petitioner was empanelled and he was called for interview in the year 2007 but only in the year 2009 recommendation was made by the West Bengal Regional School Service Commission. As per the recommendation made by the School Service Commission, the petitioner was appointed as an Assistant Teacher on 1st September, 2009 and as such the appointment of the petitioner was approved by the Additional District Inspector of School by Memo dated 12th November, 2009. Now

the petitioner submits that due to delay of two years for approval of his appointment in the post of Assistant Teacher, the seniority of the petitioner has come down in the seniority list and as such the petitioner has made a representation to the authorities for consideration of his case for his regular appointment in the year 2007 so that the petitioner can get the notional benefit in his service. Counsel for the respondents submits as the petitioner has made the representation, the respondents will consider the representation and pass an appropriate order.

In view of the submission made by the counsel for the respective parties, the Commissioner of School Education, West Bengal who is the respondent no.2 is directed to consider and dispose of the representation submitted by the petitioner dated 30th September, 2021, if necessary, a personal hearing can be given to the petitioner and to pass reasoned and speaking order within a period of six weeks from the date of receipt of this order and to communicate the same to the petitioner within a week thereafter.

With the above directions, WPA No. 676 of 2023 is disposed of.
