13.06.2023.

Ct. 3 skc In the High Court at Calcutta Circuit Bench at Jalpaiguri Constitutional Writ Jurisdiction Appellate Side WPA 682 of 2023 Sant Bahadur Thapa -versusState of West Bengal & Ors.

Ms. Monalisa Maity,Adv.

Affidavit of service filed by the petitioner be kept with the record.

The petitioner has taken voluntary retirement from his service on 13.3.2003 and PPO was issued on 19.2.2004. On 30.5.2004 gratuity and pension was released in favour of the petitioner. Now the petitioner claims interest on the gratuity amount as well as on arrears of pension from 20.2.2004 to 30.5.2004.

Considered the submission made by the petitioner, this Court finds that within one year from the voluntary retirement, respondents have released gratuity and pension of the petitioner. After the period of more than 19 years, the petitioner has filed the present application claiming interest on

gratuity and arrears of pension. This Court finds that the writ application filed by the petitioner is misconceived and petitioner is not entitled to get any interest as claimed by the petitioner.

WPA 682 of 2023 is thus dismissed.
