Mr. Sayantan Bhowmik Ms. Sayantani Das ..for the petitioner Mr. Sudipto Kumar Majumder, Ld. DSGI Mr. Sudip Kumar Paul ..for the respondents The petitioner has prayed for a direction upon the Commandant, 117 BN BSF, Roshanbagh, Murshidabad to supply the certified copy of the proceedings in Summary Security Force Court along with the order dated December 24, 2021 by virtue of which the petitioner was dismissed from service.

Learned Deputy Solicitor General appears on behalf of the respondents and submits that since the petitioner has prayed for a direction upon the Commandant, Murshidabad, the Circuit Bench at Jalpaiguri cannot exercise jurisdiction over the subject matter of the writ petition.

At this stage, the learned advocate appearing for the petitioner prays for leave to withdraw this writ

petition with liberty to approach the appropriate forum in accordance with law.

In the light of the submissions made by the learned advocate appearing for the petitioner, WPA 659 of 2025 is dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum in accordance with law.
