CALCUTTA HIGH COURT

IN THE CIRCUIT BENCH AT JALPAIGURI

30.08.2019 tkm/ct 1 C.R.M. 833 of 2019 sl no. 24 In Re : An application for anticipatory bail under section 438 of the Code of Criminal Procedure filed on 28.8.2019 in connection with Kharibari P.S case no. 66 of 2019 dated 11.3.2019 under sections 498A/304B of the IPC and In Re : Parimal Sarkar ...... petitioner Mr. A. Banerjee ...... for the petitioner Mr. Saikat Chatterjee Ms. N. Das ...... for the State Heard the learned advocates appearing for the respective parties.

Having considered the materials in the case diary disclosing prima facie involvement of the petitioner in subjecting the housewife to torture on demands of dowry soon before her unnatural death by hanging at the matrimonial home, we are of the opinion that in the view of the gravity of the offence this is not a fit case to grant anticipatory bail to the petitioner. Accordingly application for anticipatory bail is rejected. (Manojit Mandal, J.) (Joymalya Bagchi, J.)
